WHEREAS, pursuant to
NEB.REV. STAT. §39-1723, a petition
has been filed with the Sheridan
County Board of Commissioners requesting
the vacation or abandonment
of a certain road more fully described
as follows:
A Section line road along the South
line of Section31, Township 33
North, Range 45 West of the 6th
P.M. and being also the North line of
Section1, Township 32 North, Range
46 West of the 6th P.M.
WHEREAS the "Petition for Road
Closing/Abandonment/Vacation" of
the aforedescribed road appears to
meet the requirements of NEB.REV.
STAT. §39-1723;

WHEREAS the County Road Superintendent
has been directed to
study the use bing made of such public
road and sumbit in writing his report
to the County Board, and such
report and study have been submitted
to the County Board with a recommendation
for the vacation or
abandonment of the road as a County
road or County right-of-way;
WHEREAS ther is an issue regarding
whether or not the described
road is in fact a County road, open

NOW THEREFORE pursuant to
NEB.REV. STAT. §39-1724, the

a.m. The hearing shall be conducted

ORDINANCE NO. 06-106 TO
PROVIDE A FINE SCHEDULE
FOR VIOLATION OF CITY
ORDINANCE 6-106 RELATING
TO ANIMALS RUNNING AT
LARGE, AND TO ESTABLISH
IMPOUND FEES FOR DOGS
IMPOUNDED WITHIN THE

MUNICIPALITY.
BE IT ORDAINED BY THE
MAYOR AND COUNCIL OF THE
CITY OF RUSHVILLE,
NEBRASKA:
Section 1. That Chapter 6, Article
1, Section 106, of the Municipal Code
of Rushville, Nebraska be changed to
read as follows:
6-106 RUNNING AT LARGE;
DESTRUCTION, FINE
SCHEDULE, IMPOUND FEES.
"Running at Large" shall mean any
dog found off the premises of the
owner and not under the control of
the owner or a responsible person,
either by leash, cord, chain, wire,
rope, cage or other suitable means of
physical restraint. It shall be unlawful
for the owner of any dog to suffer or
permit such dog to run at large within
said City, and every dog found running
at large in violation hereof is declared
to be a public nuisance and may be
picked up and impounded by the
animal control officer or city police
officer.
A fine schedule for violation of this
section is hereby established as
follows:

First Offense - $30.00 and court
costs.
Second Offense - $60.00 and court
costs.
Third Offense - $90.00 and court
costs.
Fourth Offense - dog will be
disposed of.
In addition, the owner of any dog
impounded pursuant to this section
shall be responsible for payment of
an impoundment fee in the sum of
$5.00 per day for any dog impounded.
Payment of the impoundment fee and
fine, shall be a pre-requisite to release
of the animal from the City's impound
facility.
If more than four years have passed
since the last violation of this section,
then in that event, a new violation will
not constitute a subsequent offense.

TRUCK ROUTES WITHIN THE
CITY LIMITS OF RUSHVILLE,
NEBRASKA, PROHIBITING
OVERNIGHT PARKING BY
TRUCKS; PROHIBITING THE
USE OF ENGINE BRAKES
WITHIN CITY LIMITS OF
RUSHVILLE, NEBRASKA; AND
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE
MAYOR AND COUNCIL OF THE
CITY OF RUSHVILLE,
NEBRASKA.
Section 1. That Chapter 5, Article
1, Section 102 of the Municipal Code
of Rushville, Nebraska be amended
to read as follows:
S5-102 Truck Routes, Overnight
Parking, Engine Brakes, It shall be
unlawful for anyone to operate a semi
tractor-trailer, or loaded straight truck
(single back axle with a gross vehicle
weight (GVW) of 10,000 pounds or
more) on any paved street within the
City Limits of the City of Rushville,
with the exception of the following
designated streets which by this
ordinance are designated truck routes:
• Third Street from Cemetery Road
to State Highway 250
• Main Street
• Sale Barn Road
This prohibition shall not apply to
delivery trucks, making deliveries in
the normal course of their business.
It shall be unlawful for anyone to
park a semi tractor-trailer, or loaded
straight truck (single axle with a gross
vehicle weight (GVW) of 10,000
pounds or more), or any farm tractors
of farm machinery overnight on any
paved street within the municipality.
It shall be unlawful for anyone
operating a truck equipped with an
engine braking device (jake brake) to
use the engine braking device while
operating the truck within the city
limits of the City of Rushville,
Nebraska. The governing body shall
cause notices to be posted or shall
erect signs indicating that engine
braking is not allowed within the
municipality.
Section 2. That any other ordinance
or section passed and approved prior
to the passage and approval, or posting
of this ordinance and in conflict with
its provisions, is hereby repealed.
Section 3. This ordinance shall take
effect and be in full force from and
after its passage, approval, and
publication or posting, as required by
law.

AN ORDINANCE TO
AMEND THE APPOINTMENT
OF LIBRARY BOARD
MEMBERS TO INCLUDE NONRESIDENT
MEMBERS AND
TO ESTABLISH TERMS FOR
LIBRARY BOARD MEMBERS:
Be it ordained by the Mayor and
Council of the City of Rushville,
Nebraska.

Section 1. That Chapter 2, Article
2, Section 201 of the Municipal Code
of Rushville, Nebraska be amended
to read as follows:
S2-201 LIBRARY BOARD
(1) The Library Board shall consist
of five (5) appointed members, which
shall consist of at least three (3)
members who are residents of the
Municipality and two (2) members
who may reside outside the City limits
and also shall serve terms of four (4)
years. The Governing Body shall
appoint the members of the Library
Board by a majority vote. Neither the
Mayor nor any member of the
Governing Board shall be a member
of the Library Board. The terms of
members serving on the effective date
of a change in the number of members
shall not be shortened, and any
successors to those members shall be
appointed as the terms of those
members expire. In case of any
vacancy by resignation, removal or
otherwise, the Governing Body shall
fill the vacancy for the unexpired term.
(2) No member shall received any
pay or compensation for any services
rendered as a member of the Library
Board. The Governing Body may
require the members of the Library
Board to give a bond in a sum set by
resolution of the Governing Board to
give a bond in a sum set by resolution
of the Governing Body and
conditioned upon the faithful
performance of their duties.
(3) At the time of the Board's first
meeting in July of each year, the Board
shall organize by selecting from their
number a Chairperson and Secretary.
No member of the Library Board shall
serve in the capacity of both
Chairperson and Secretary of the
Board. It shall be the duty of the
Secretary to keep the full and correct
minutes and records of the meetings,
and to file the same with the Municipal
Clerk, where they shall be available
for public inspection at any reasonable
time.
(4) A Majority of the Board
members shall constitute a quorum for
the transaction of business. The Board
shall meet at such times as the
Governing Body may designate.
Special meetings may be held upon
the call of the Chairperson, or a
majority of the members of the Board.
(5) The Library Board shall have
general charge of the Municipal
Library and shall establish appropriate
rules and regulations for the
management, operation, and use of the
Library. All actions of the Board shall
be subject to the review and
supervision of the Governing Body.
The Board shall be responsible for
making such reports and performing
such additional duties as the
Governing Body may designate from
time to time.
Section 2. That any other ordinance
or section passed and approved prior
to the passage, approval or posting of
this ordinance and in conflict with its
provisions, is hereby repealed.
Section 3. This ordinance shall take
effect and be in full force from and
after its passage, approval, and
publication or posting, as required by
law.

The meeting was called to order by
Mayor Richard Jones at 7:00 p.m. as
per the Municipal Code of the City of
Rushville, Sheridan County, NE.
Notice of the meeting was given by
publication in the Sheridan County
Journal Star on March 26, 2008 as
required by law and delivered to the
Council in person. Sones, Graham,
Beguin, and Hinn were present for
roll call.
The following motions were duly
made, seconded and passed.
1. To approve, accept and ratify the
following items listed under the
consent agenda: Minutes of the

February meeting and Treasurers
report.
2. Motion to accept bid from
Mansfield Enterprises to install a
Geothermal heat system in the old
hospital building.
3. Motion to have the City purchase
a 40 foot culvert for installation of a
driveway into the property purchased
by John Fresquez.
4. Motion for passage of
Resolution 08-02, a Resolution
authorizing chief elected official to sign
an application for Nebraska
Affordable Housing Program Funds.

Prevention Coalition, representing 10
counties in western Nebraska, joined

Prevention Coalition desires the

expand and strengthen regional efforts
to increase physical fitness, improve
nutrition and curb smoking among
residents of the Panhandle.

Two Public Hearings were held
during the meeting, Nebraska
Affordable Housing Program and
USDA Water Project.
Tom Thomas was present to update
the Mayor and Council on the Walk/
Bike Trail. They are currently waiting
on one easement to be signed and
returned. Once it is received, they will
be able to go forward with advertising
for a contractor and the actual work.
The purchase of a snow blower and
a cab for the new City mower was
discussed and will be put into the
Street and Alley Budget for next year.

COMMISSIONERS MINUTES
MARCH 31, 2008
The Sheridan County
Commissioners met in regular at 9
A.M. In the Commissioners Office,
Courthouse. All member present,
Harlen Wheeler from the Sheridan
County Journal Star was present.
Andersen stated that the open meeting
law poster is posted in the back of the
room and that the meeting was
published in the legal newspaper of
record. Kling made a motion to accept
the agenda with a cancellation of
Roberta Mues. Krotz seconded the
motion. With a voice vote all voted
aye. Krotz made a motion to accept
the minutes of 3/27/08 with
corrections. Kling seconded the
motion. With a voice vote all voted
aye.
The board audited and approved
claims and signed salary checks.
Reviewed a list of surplus items
submitted by various county offices.
The board decided to extend the
submission period.
The board met with Road
Superintendent Yardley, Marv Van
Houten, Mike Machata, Lyle and Celia
Barth and Jack Beguin about 470th
Trail. They are requesting the County
to consider that road as a designated
County road. The board asked
Yardley to research the legal status of
the road and report back to them on
April 14.
Jack Beguin was concerned about
the other portion of Road #470 aka
the Sandoz cut across road. This is
the only East/West road across the
County from Hwy 87 to Hwy 250.
The board stated that they could
consider improvements to the existing
minimum maintenance road when the
next one and six road plan is
developed.

Roberta Mues of the United States
Department of Agriculture Rural
Development office was scheduled to
meet with the Board to discuss
financing services offered by the
USDA for such projects as
Courthouses and Jails. Bad weather
and icy roads prevented Ms. Mues
from attending the meeting. Her visit
with the Board was rescheduled for
April 14, at 1 P.M.

Commissioners Jack Andersen
(President), Dan Kling and James
E. Krotz were present.
Acting as the Board of
Equalization:
Approved the acceleration of
taxes on a mobile home sold by
Danny and Helen Leggett.
Received a report from the
Assessor on a permissive
exemption for the radio tower
owned by the Christian
Community Center of Clinton.
The tower is currently
inoperative but, when returned to
service, will be used exclusively
for religious broadcasting and
therefore qualifies for exemption.
Acting as the Board of
Commissioners:
Discussed with the Assessor
the ongoing problems of
compatibility between the new
computer hardware and software
in her office. Determined to
investigate the hardware
specifications submitted by the
vendors so as to ascertain
potential liability.
Received a report from the Road
Superintendent concerning that
portion of 470th Trail from Highway
250 to Deer Creek Farms. Reviewed
the records concerning the
development of that road and
decided to seek the opinion of the
County Attorney concerning
whether or not the actions of the
Board taken in 1982 served to add
that section of road to the county
system and/or establish a
maintenance agreement.
Directed the County Attorney
to inform Stephen Johndreau that
he, as the landowner, should
initiate any desired proceedings
to vacate and abandon roads
leading though his property.
The Road Superintendent
infomed the Board of his intent to
purchase a 2008 Ford F-150 4x4
pickup truck from Sides and
Milburn of Rushville under the
provisions of the State of Nebraska
Contract Award Program.
